By accessing or using MySecureSend (“the Service”, “the platform”, “we”, “our”, “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
These Terms are governed by the laws of New South Wales, Australia. By using the Service, you submit to the exclusive jurisdiction of the courts of New South Wales.
MySecureSend is a B2B software-as-a-service platform that enables professionals to send password-protected, encrypted file attachments via email, with passwords delivered via SMS. The Service is invite-only and intended for use by Australian businesses in regulated industries including medical, legal, finance, and real estate.
You must be at least 18 years old and have the authority to bind your organisation to these Terms. By using the Service, you represent that you meet these requirements.
You agree to use the Service only for lawful purposes. You must not use the Service to:
We reserve the right to suspend or terminate accounts that violate these requirements without notice.
The Service sends SMS messages containing decryption passwords to recipient mobile numbers that you supply. By using the Service, you represent and warrant that:
MySecureSend requires you to tick an “SMS consent” checkbox for each send. This is a mandatory acknowledgement - ticking it is your representation that consent has been obtained. We are not liable for any breach of the Spam Act 2003 or any other law arising from your failure to obtain valid consent.
Zero file retention: Files uploaded to the Service are encrypted in-memory using AES-256 and transmitted to the recipient. Files are never written to persistent storage and are discarded immediately after transmission. We cannot recover, reproduce, or provide access to any file.
Audit log: Send metadata (recipient email, file names, subject, delivery status) is retained for compliance purposes. See our Privacy Policy for full details.
Your content: You retain all rights to the files you send through the Service. By using the Service, you grant us a limited, non-exclusive licence to encrypt and transmit your files solely for the purpose of delivering the Service.
You are responsible for maintaining the security of your account credentials and OAuth2 connections. You must notify us immediately at support@mysecuresend.com.au if you suspect unauthorised access to your account. We are not liable for any loss arising from unauthorised use of your account.
Subscription fees are charged in advance on a monthly basis. All prices are in Australian dollars (AUD).
Subscriptions renew automatically. You may cancel at any time via account settings - cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods.
We reserve the right to change pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.
We aim to maintain high availability but do not guarantee uninterrupted access. We will endeavour to provide advance notice of scheduled maintenance. We are not liable for any loss or damage arising from downtime, service interruptions, or technical failures.
To the maximum extent permitted by law, MySecureSend and its officers, directors, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
Our total aggregate liability for any claim arising from these Terms or your use of the Service is limited to the total fees you paid to us in the preceding period.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or other right or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted, or modified.
You agree to indemnify and hold harmless MySecureSend and its affiliates from any claims, damages, costs, or expenses (including legal fees) arising from your use of the Service in breach of these Terms or any applicable law.
Either party may terminate these Terms at any time. You may close your account via settings. We may suspend or terminate your account if you breach these Terms, with or without prior notice depending on the severity of the breach.
Upon termination, your access to the Service will cease. Audit log data may be retained for legal compliance obligations as described in our Privacy Policy.
All intellectual property rights in the Service, including software, design, trademarks, and documentation, belong to MySecureSend. Nothing in these Terms transfers any IP rights to you. You may not copy, modify, reverse-engineer, or create derivative works from the Service.
We may update these Terms from time to time. Material changes will be notified by email at least 14 days before taking effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
